Along with the JobKeeper Extension (JobKeeper 2) announcements the government also announced a change that was affective from 3 August 2020 that confused many and needed clarification.

It has been clarified and confirmed now. 

The Employee eligibility employment start date has changed and therefore more employees are eligible for JobKeeper now.

Full-Time & Part-Time employees must have started employment before 1 July 2020.

Long-term casual Employees must have been employed on a regular and systematic basis for at least the 12-month period that ended 1 July 2020 and is not a permanent employee of any other organisation

This means that employees who started work for an eligible employer between 1 March 2020 and 30 June 2020 may be eligible for a JobKeeper fortnight starting on or after 3 August 2020 if they:

    • are employed at any time in the JobKeeper fortnight
    • didn’t receive any of these payments during the JobKeeper fortnight for
      • government parental leave or Dad and Partner Pay
      • a payment in accordance with Australian workers compensation law for an individual’s total incapacity for work
    • agree to be nominated and completed the Nomination form
    • they were employed as either a:  
      • non-casual employee (whether full-time, part-time, or fixed-term)
      • long term casual employee (employed on a regular and systematic basis during the 12-month period that ended 1 July) and not a permanent employee of any other employer
    • they were 18 years or older (if they were 16 or 17 they can also qualify if they were independent or not studying full time on 1 July 2020)
    • were an Australian resident under the Social Security Act 1991,


You can’t claim for any employees who:

    • were first employed after 1 July 2020
    • left your employment before 1 July 2020
    • have been, or have agreed to be, nominated by another employer
    • if you are an approved provider of child care services, have ordinary duties relating principally to the operation of those services for a JobKeeper fortnight that commences on or after 20 July 2020.

If you want to claim JobKeeper payments for new employees.

That is employees who:

  • have begun Full-time or Part-Time employees between 1 March 2020 and 1 July 2020, or
  • are Casual employees who were employed on a regular and systematic basis during the period of 12 months ending on 1 July 2020.

To receive JobKeeper payments for fortnights commencing on 3 August 2020 and 17 August 2020, the ATO is allowing employers until 31 August 2020 to meet the wage condition for all new eligible employees included in the JobKeeper scheme under the 1 July eligibility test.

To claim payments for August pays all the documentation needs to be collected, employees paid and payroll system updated by 31st August.

This means that:

  • new eligible employees must complete the Employee Nomination form (click here for the form) and
  • the appropriate JobKeeper Top-Up payments must be paid if applicable
